Changes to Wisconsin’s Class Action Statute

Dear Local and Specialty Bar Leaders:

The Evidence & Civil Procedure Committee of the Wisconsin Judicial Council has been tasked with studying possible amendments to Wisconsin’s class action statute, Wis. Stat. § 803.08.  The committee has recommended that the current statute be repealed and replaced with a statute based on Rule 23 of the Federal Rules of Civil Procedure.  The committee has also recommended repeal of certain subsections of Wis. Stat. § 426.110.

A proposed rule draft is attached because the committee identified your organization as one that might be interested in this project.  If you or other members of your organization have any comments or suggestions regarding this proposed rule draft, please submit them to me electronically no later than September 2, 2016.  If you would like to provide input, but are unable to do so by September 2nd, please let me know.
